Terms of Service

These Terms of Service ("Terms") govern your use of 123smith.com and its tools (the "Service"), operated by 123smith ("we", "us"). By using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

123smith generates QR codes and vCard contact codes. Standard ("static") codes are created in your browser and encode your data directly into the image. Once downloaded, they belong to you and function independently of us, forever.

2. Free plan, Signature & subscriptions

• Free. Generating and downloading standard codes is free. Free exports may include a small 123smith watermark.
• Signature (one-time). A single payment unlocks Signature features (such as logo embedding, custom fonts, SVG export and watermark removal) for your use. It is a licence, not a transfer of ownership of the software.
• Subscriptions (dynamic codes). Dynamic codes and analytics are billed monthly on the Starter, Unlimited or Teams plan until cancelled. If you cancel, your dynamic codes keep redirecting for a 30-day grace period, after which they pause until reactivated by resubscribing. Static codes are never affected. Teams also includes the Signature design features and (as they roll out) team seats.

3. Payments & refunds

Payments are processed by our merchant-of-record, Polar, who issues receipts and handles applicable taxes. Prices are shown before purchase. If you're unhappy with a Signature purchase, contact us within 30 days for a refund. Subscriptions can be cancelled at any time and will not renew after the current period.

4. Acceptable use

You agree not to use the Service to create or distribute codes that:

• link to malware, phishing, fraud, or unlawful content;
• infringe others' intellectual property or privacy rights;
• harass, deceive, or endanger others; or
• violate any applicable law or regulation.

You are solely responsible for the content you encode and where your codes point. We may disable dynamic codes that violate these Terms.

5. Your content

You keep all rights to the data and logos you provide. For standard codes we never receive that content. For dynamic codes, you grant us the limited licence needed to host the redirect and show you analytics. You confirm you have the rights to any logo or content you upload.

6. Intellectual property

The Service — its software, design, and brand — belongs to 123smith. These Terms don't give you rights to our name or logo beyond using the Service as intended.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind. We don't guarantee that a given code will scan on every device, or that the Service will be uninterrupted or error-free. Always test a code before printing it at scale.

8. Limitation of liability

To the maximum extent permitted by law, 123smith will not be liable for indirect, incidental, or consequential damages, or for lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Changes

We may update these Terms as the Service evolves. Material changes will be reflected by the "last updated" date and, where significant, highlighted on the site. Continued use after changes means you accept them.

10. Governing law

These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-law rules. Courts located in that jurisdiction will have exclusive jurisdiction over any disputes, except where mandatory local consumer law provides otherwise.
